Our Terms and Conditions
- By placing an order for any goods or services (“Order”), you are deemed to accept these Terms and Conditions.
- These Terms and Conditions constitute the entire agreement between you and Invivo for any Order.
- Invivo reserves the right to modify, amend, or update these Terms and Conditions at its sole discretion.
- If any part of these Terms and Conditions are deemed unreasonable, void or otherwise unenforceable in any legal, arbitration or similar proceedings, it is the intention of the parties that the enforceability of the remaining parts of these Terms and Conditions will not be affected.
Disclaimer – this section is very important
- Our products and services or any information provided by us are not a substitute for seeking appropriate medical advice nor are they a means to cure, treat, prevent, diagnose or mitigate any disease, illness or other medical condition.
- Our products and services support wellbeing and are not designed for emergencies nor to replace the physician’s duty of care and personalised care practice.
- If you are under the care of a physician, you should consult with your physician prior to using any of our goods or services. If information obtained from using our services is inconsistent with the advice given by the physician, your physician’s advice should be followed.
- We do not provide medical advice or medical care.
- If you choose a healthcare provider registered with Invivo in order to access any of services (“Healthcare Provider”), you do so at your own discretion. Invivo does not in any way accept any liability or responsibility (save for any liability that cannot be restricted by law) whatsoever for the use by you of a Healthcare Provider. You should undertake your own full enquiries as to suitability and expertise before choosing a Healthcare Provider.
- We have tried to ensure that information provided on our web site is accurate. However, we make no representation and give no warranty of any kind in respect of the information.
- We do not accept liability for any loss (direct, indirect or consequential) which may arise from reliance on information contained on our web site or in respect of any error or omission, except in relation to death or personal injury caused by our negligence.
- Our total aggregate liability of any kind (including our own negligence) is limited to the total charges paid by you to us in connection with your Order.
Our Supplements
- Our supplement products are available for purchase with or without the recommendation of a Healthcare Provide. Purchasing our supplements is solely at your discretion.
- We bear no responsibility for the outcomes resulting from your use of any our supplements.
- The description and specification of our supplement products on our web site is only approximate and we reserve the right to make changes which do not materially affect the quality or performance of those products.
- We may correct any error appearing on our web site or withdraw any product from sale without incurring liability.
- Price and availability of our supplemental products is subject to change without notice.
Our Tests
- You can only order test kits and use our testing services if you are actively engaged with a Healthcare Provider.
- Our tests are designed to assess specific parameters, conditions, or characteristics. They identify the presence, or absence of, certain target strains of microbes. This process may involve the collection and/or analysis of biological samples/materials or is data to obtain relevant information.
- The test results provided by Invivo are for information purposes only and are not intended to be used for or as a replacement for medical advice or diagnoses nor to replace a physician’s duty of care and personalised care practices.
- We do not provide interpretive support for our testing services. Please speak with your Healthcare Provider about interpreting your results.
- Our tests are self-administered. Please follow the instructions supplied with our test kits. We cannot be held responsible for inaccurate or incorrect test results which arise from the incorrect use of our test kits. Please contact us if you have any questions about using our test kits.
- You are required to collect, package, and return your samples to Invivo within 12 months from the date you purchased the test kit.
- We can only accept samples that are collected, packaged and sent to us in accordance with the instructions supplied with our test kit.
- In the event that you fail to provide a sample within the 12 month period or the sample has not been packaged in accordance with our test kit instructions, we may reject the sample without liability or refund.
- We may provide replacement test kits where test kits have expired. You will be responsible for paying for posting and packaging costs. If a price change is implemented during this period, we reserve the right to add any additional price increases to an amended sales order or invoice.
- We will provide replacement test kits where test kits have become invalid due to incorrect specimen collection, user error, damage to the collection materials or packaging, at a cost of £25.00 (includes postage and packaging).
- We will provide replacement test kits where samples provided do not meet our minimum laboratory acceptance criteria due to user error (e.g. incorrect sampling method or packaging), at a cost of £25.00 (includes postage and packaging).
- We will provide replacement test kits where samples have been rejected due to any failure on our part, free of charge. Our liability in such circumstances shall be solely limited to the cost of the replacement test kit (including postage and packaging).
- As a guideline, we aim to provide test results within 15 working days from the date of receipt of the sample. This time period is a guideline only and in some cases, results may take longer. We are not liable for any delay in providing the test results and we shall not be liable for any loss or damage directly or indirectly caused by any delay.
- We do not offer an expedited results service. Partial results are not released.
- All test results are provided only to your Healthcare Provider through our secure and access controlled Laboratory Results Portal. Results will not be provided directly to you. Your Healthcare Provider is responsible for ensuring timely access to the Laboratory Results Portal. We are not responsible for any delays caused by the Healthcare Provider in retrieving the test result and/or communicating the results with you. All enquiries or matters relating to the test results must be directed to the relevant Healthcare Provider.
Placing an Order
- You may place an Order through our web site by adding product(s) to your basket and selecting “Checkout.” Orders can also be placed via email or by telephone. Our test kits can only be purchased if you are actively engaged with a Healthcare Provider.
- We reserve the right not to fulfil Orders for products that are unavailable, even if you were able to purchase them at the time of placing the Order.
- In the event that any products become unavailable after you have placed an Order, we will notify you as soon as possible. We will dispatch the unavailable products when they become available or offer a refund for the value of the out-of-stock products.
- It is your responsibility to ensure the accuracy of the information provided during the ordering process, including your delivery address and the selected product. Please promptly inform us of any errors.
Price and Payment
- The price of our products is the price quoted on our web site at the time we accept your Order. The price will include any applicable VAT, but not the cost of delivery.
- In addition to the price, you will have to pay our delivery charges as quoted on our web site at the time we accept your Order, unless you qualify for free delivery. Delivery charges vary according to the method of delivery and the delivery address you specify in your Order and will be confirmed at checkout.
- Payment for our products and services is made via our payment page. Your Order will only be complete once full payment has been received.
- Whilst we regularly review our web site, items may occasionally be mis-priced. In this event we will either contact you to ask if you wish to cancel the Order, or simply cancel the Order and notify you, at our own discretion. We are under no obligation to supply goods at the incorrect price.
Discount Codes
- Discount codes provided by Invivo are applicable to online Orders only and shall not apply to Orders placed by telephone or by email.
- Discount codes must be applied at the time the Order is placed online. Discount Codes cannot be applied retrospectively.
- Discount codes are not valid in conjunction with any other discount codes, promotions or offers unless otherwise stated.
- In the event of part of an Order being returned or refunded, the monetary value returned will be the value of the products at the time of the transaction (which will include any discount applied).
- Discount codes cannot be applied to replacement items. If the offer is still valid at the time of making a return, you should place a new Order using the original discount code.
- Expired discount codes are invalid and cannot be extended.
- Invivo reserves the right to modify, cancel, or discontinue any discount code at its discretion and without prior notice.
- Any attempt to manipulate, abuse, or misuse discount codes may result in the cancellation of the associated Order and/or other actions deemed necessary by Invivo.
Delivery
- We deliver the products you Order by the method and to the address which you request in the checkout process. The time for delivery will not be essential to the contract between us.
- If you do not take delivery of the products or supply adequate delivery instructions, we may cancel your Order and retain the products. In this event, we will refund you the price of the products, but you will still be liable to pay any delivery charges.
- If there is an error or any other delivery problem in respect of the products ordered, you must notify us in writing within 14 days after the delivery date. We will not be liable for any loss or damage if you fail to do this.
Right to cancel
- Subject to the remaining provisions of this section 10:
- If you live in the “European Economic Area”, you have the right to cancel this Order within 14 days without giving any reason.
- The cancellation period will expire after 14 days from the day of the conclusion of the Order. If you cancel your Order, we will reimburse to you all payments received from you, including the costs of delivery.
- We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.
- We will make the reimbursement without undue delay, and not later than 14 days after the day we receive back from you any goods supplied.
- We will make the reimbursement using the same means of payment as you used for the initial transaction.
- You shall send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation of the Order to us. The deadline is met if you send back the goods before the period of 14 days has expired.
- You will bear the direct cost of returning the goods.
- You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
- Returns are not accepted on goods after 14 days of the date of purchase.
- The above rights remain unaffected by any other returns policy specified in these Terms and Conditions or in any published material by Invivo.
- The right to cancel does not apply to Orders for the supply of products likely to deteriorate or expire rapidly.
- You forfeit the right to cancel Orders for the supply of sealed goods that are not suitable for return due to health protection or hygiene reasons, or if they become unsealed after delivery.
- In the event that the products are found to be faulty or incomplete upon receipt by you, you are entitled to a replacement or refund in accordance with applicable laws.
Privacy
You may be required to provide certain personal information to Invivo. You acknowledge and agree that we may process your personal information in accordance with the terms of our Privacy Policy which is subject to change from time to time.
No white labelling, over labelling, re-labelling or translation
- Our products must not be white labelled, over-labelled or re-labelled under any circumstances.
- No labels on our products or product information shall be translated or modified.
Intellectual Property
- The material on our web site is copyright to Invivo or to our content and technology providers. You may view, print and download the contents of the web site for personal use, but not for any commercial purposes or re-publication.
Third party rights
- The contract entered into between us pursuant to these Terms and Conditions is between you and us. No other person has any rights to enforce any of its terms.
No re-sale
- The products advertised on our web site are intended for sale to persons dealing as consumers and are not for re-sale under any circumstances.
Governing law
- Any contract between us shall incorporate these Terms and Conditions and be under English law. If there is any dispute, the English Courts will have exclusive jurisdiction.
